QR codes generated through TrackQR are your property. You may use them for any lawful purpose, including commercial use. However, we retain the right to:

• Store and display your QR codes for the purpose of providing analytics
• Use aggregated, anonymized data for service improvements
• Remove or disable QR codes that violate these Terms

For dynamic QR codes, the destination URL can be updated at any time. If your account is terminated or suspended, dynamic QR codes may stop functioning.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRACKQR AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Service interruptions or data loss
• Unauthorized access to your account or data
• Errors, mistakes, or inaccuracies in content
• Third-party content or conduct

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Our Services may contain links to third-party websites or integrate with third-party services. We are not responsible for the content, privacy practices, or terms of service of third-party websites or services. Your interactions with third parties are solely between you and the third party.

While we implement security measures to protect your data, you are responsible for maintaining backups of your QR codes and content. We are not liable for any loss of data resulting from technical issues, security breaches, or account termination.

You agree to comply with all applicable export and import laws and regulations. You represent that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and you are not on any U.S. government list of prohibited or restricted parties.

16. Dispute Resolution and Arbitration

Any disputes arising from or relating to these Terms or our Services shall be resolved through binding arbitration, except where prohibited by law. You waive your right to a jury trial and to participate in class action lawsuits.

Before initiating arbitration, you agree to contact us to attempt to resolve the dispute informally. If we cannot resolve the dispute within 60 days, either party may initiate arbitration.
